GENERAL TERMS AND CONDITIONS
OF SALE OF THE SITE

 

Article 1: Definitions

Parfums GODET: this term designates the company Parfums GODET, S.A.S. with a capital of 20,000 €, intra-community VAT number: FR 09 828 078 329, registered in the Antibes Trade and Companies Register under the number and whose head office is located at 98, rue Grande, 06570 Saint-Paul de Vence.

Site: this term designates the Parfums GODET online sales website:
www.parfumsgodet.com on which the Products are presented and sold to the Customer.

Product(s): this term designates the perfumery, cosmetics and accessories marketed by Parfums GODET and offered for sale on the Site.

Client: this term designates the Internet user, a natural person and not a professional, who navigates and/or orders one or more Products on the Site for personal use.

Party(ies): this term designates Parfums GODET and/or the Client, alternatively or collectively.

Order: this term designates the sales contract concluded between Parfums GODET and the Client.

 

Article 2: Purpose

The purpose of the present General Terms and Conditions of Sale is to define the terms and conditions under which Parfums GODET proposes the sale of Products on its Site to Clients, as well as the rights and obligations of the Parties resulting from the online sale of these Products on the Site.

The Customer acknowledges having read and expressly accepted the General Terms and Conditions of Sale in force on the date of the Order, prior to placing the Order on the Web site. This acceptance is in no way conditional upon a handwritten signature by the Customer. These General Terms and Conditions of Sale are made available to Customers on the Site and may also be sent to them on request by e-mail or post.

It is specified that the Client can save or print the present General Conditions of Sale on the condition that he does not modify them. Parfums GODET reserves the right to update the General Conditions of Sale at any time. In case of modification of the General Terms and Conditions of Sale, those in force at the date of the Order will be applicable.

The General Terms and Conditions of Sale apply to all online sales made on the Site to the exclusion of any other document, and in particular the conditions applicable to sales in shops or through other distribution and marketing channels.

The resale or distribution of Parfums GODET products purchased on the website is strictly forbidden.

 

Article 3: Products

Parfums GODET offers for sale, within the limits of available stocks, the Products listed only on the Site, on the day of consultation by the Customer. Parfums GODET reserves the right to withdraw Products from the online sale at any time and without prior notice.

All offers of Products proposed on the Site are limited to Orders placed for delivery in Metropolitan France (including Corsica), Monaco, Andorra, Germany, Belgium, Luxembourg, the Netherlands, Austria, Spain, Great Britain, Italy, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Ireland, Denmark, Portugal, Finland, Bulgaria, Romania, Turkey, Switzerland.

Parfums GODET tries to meet the requirements of article L 111-1 of the French Consumer Code. Before placing an Order, the Customer can thus take note, on the Website, of the essential characteristics of the Product(s) he wishes to Order. Nevertheless, the photographs illustrating the Products sold on the Site are not part of the contractual field and are for information purposes only.

 

Article 4: Prices

The price in force is that indicated on the Site. Prices are expressed in euros and include all taxes, including the VAT applicable in France on the date of the Order. For countries outside the European Community, sales shall be made without tax.

Prices do not include shipping costs for the Products, which will be invoiced in addition and which will be indicated before the Order is registered by the Customer.

Parfums GODET reserves the right to modify its prices at any time, it being understood that the Products ordered will be invoiced at the price in force at the time the Order is registered.

 

Article 5: Ordering

The Products ordered by the Customer are intended for the Customer’s personal use, without any direct connection with his/her professional activity.

To purchase the Products, the Customer must log on to the Site and enter his/her e-mail address and password or create an account where he/she must enter his/her title, surname, first name, address, e-mail address and password.

The validation of any Order implies the Customer’s full and unconditional acceptance of these General Terms and Conditions of Sale.

The Customer’s Order shall only be definitively validated once he/she has chosen his/her delivery and payment method and clicked on the “Checkout” button, it being understood that before clicking on the “Checkout” button, he/she may check the details of his/her Order and its total price, and modify or cancel it if necessary.

The Customer accepts that the validation of the Order shall constitute an agreement between the Parties. The validation of the payment by the Client and an e-mail confirming receipt of the Order by Parfums GODET will be considered as proof of acceptance of the Order and its final validation. The data recorded by Parfums GODET and the payment service provider constitute proof of the nature, content and date of the Order.

Consequently, as soon as the Order is definitively validated, the Customer will no longer be able to cancel or modify his Order, subject to the provisions of article 10 of the present General Terms of Sale. Payment shall then be triggered as soon as the Order has been validated.

In the event of unavailability after the Order has been placed, the Customer shall be informed by e-mail as soon as possible. The Order will be cancelled, the payment will be credited back to the Customer, and PARFUMS GODET will inform the Customer as soon as the product is available again. PARFUMS GODET does not accept any responsibility in the event of stock shortages or unavailability of Products.

Parfums GODET reserves the right to cancel any Order from a Customer with whom there is a previous dispute or for any other legitimate reason, particularly in the case of an Order for unusual quantities and/or amounts for a final consumer.

Orders placed for delivery outside of France may require different processing times, especially for deliveries of Orders excluding VAT.

 

Article 6: Payment

All Orders are payable in Euros.

  • Credit card
    Payment is made by credit card (Visa, Mastercard) exclusively through the secure Paybox system connected to Crédit Mutuel. Our secure payment is managed entirely by the Paybox system. All information is encrypted and transmitted directly to Paybox without passing through our site. All transactions are secured using SSL encryption, guaranteeing both the identity of the payment organisation and the confidentiality of the data.
  • Paypal
    For all Paypal account holders, the payment is made online, through this account, by simply indicating the Paypal email address and password.
    Thus, the financial information of the customer is never communicated to Parfums Godet. PayPal encrypts and protects the card number once and for all.

  • The Customer provides his credit card number with the expiry date and the CVX code. He finally validates his order by clicking on the “Confirm” button.
    To secure the payment, in certain cases, the confirmation of the payment is only done after having entered a 3D-Secure code provided by the bank. By ticking the “Memorise” box, the Customer accepts that the number of his/her bank card associated with the expiry date be kept for future purchases.

The full amount of the Order shall be debited from the bank account as of the date of the Order.

In case of refusal to authorise payment by credit card by the officially accredited and usual Internet organisations or in case of non-payment or in case of non-payment of all or part of a previous Order, Parfums GODET reserves the right to suspend all Order management and delivery.

In accordance with the French Data Protection Act of January 6, 1978, the Customer has the right to access, rectify and oppose all personal data at any time.

 

Article 7: Delivery

The Products ordered by the Customer in accordance with these General Terms and Conditions of Sale shall be delivered to the address indicated by the Customer as the delivery address when placing the Order.

The delivery period begins as soon as the e-mail confirming the Order is sent.

In accordance with current law, Parfums GODET commits itself to executing the Order within a maximum of thirty days from the day the Order is validated, subject to availability and full payment of the price. If the goods are not delivered within this period, the Customer may cancel the Order and obtain a refund.

 

Article 8: Reservation of ownership

The Products remain the property of Parfums GODET until the price of the Order is paid in full. No dispute concerning the delivery itself is possible if the package appears to have been delivered, the carrier’s computer system or the receipt slip being proof.

 

Article 9: Receipt of the Order – Complaints – Information

Upon receipt of the package, the Customer is required to check the conformity and condition of the packaging of the Products and to raise any apparent defects. In case of deterioration or partial loss of the Product, the Client must imperatively formulate reserves that must be written on the delivery receipt presented by the carrier and then communicate them by email, mail or telephone to the attention of Parfums GODET.

For any information, complaint, question concerning the Products and their use or the conditions of mail order sales, the Client must contact Parfums GODET’s Customer Service by e-mail at: sonia@parfumsgodet.com or by mail or by telephone at 06 69 12 38 68, quoting the number of the Order.

 

Article 10: Right of withdrawal

As from the delivery of the order, and in accordance with the provisions of article L. 121-20 of the French Consumer Code, the Customer has a period of fourteen clear days to notify his wish to exercise his right of withdrawal.

The Customer shall have a period of fourteen days to return the unopened products ordered to the same address, at his expense and in their original packaging. It is the Customer’s responsibility to take care of the packaging of the returned products.

In the absence of the return of the Order within the given time limit, the Order will be considered final and no reimbursement will be made, except in the cases provided for in the present General Conditions of Sale.

 

Article 11: Legal guarantee and return of items

The Customer benefits from the legal guarantee of conformity and the guarantee of hidden defects provided for in articles 1641 and following of the Civil Code. Parfums GODET commits itself, in case of non-conformity of the Products in relation to the Order or delivery of a Product revealing a hidden defect, after reception of the returned Product, either to exchange the Product for a Product of equivalent quality and price according to the availability of the stock, or to reimburse the Customer by retrocession on the bank card that was used for the purchase corresponding to the price of the Product within a maximum period of 15 days.

 

Article 12: Responsibility

Parfums GODET is only bound by an obligation of means. It is up to the Client to judge the appropriateness and suitability of the items ordered. Parfums GODET cannot be held responsible for the use of products that do not conform to their intended purpose.

As the delivery is assured by a third party, Parfums GODET declines all responsibility in case of excessive delivery time due to the postal services, as well as in case of loss of the ordered Products or a strike of the postal services. The Client assumes the risks concerning the products delivered from the moment he takes possession of them at the time of delivery.

Parfums GODET can only be held responsible in the case of a proven fault that is exclusively attributable to it.

 

Article 13: Force majeure

Parfums GODET cannot be held responsible for the total or partial non-execution of its obligations, if this non-execution is due to a fortuitous event or the occurrence of an element constituting force majeure. These events constitute a cause for suspension and/or extinction of the obligations of Parfums GODET towards the Customer, without compensation to the Customer.

 

Article 14: Intellectual Property

In accordance with the laws and conventions governing intellectual property or other similar rights, the present website and all the elements, trademarks, drawings, models, photographs, texts, illustrations, logos, animated sequences or not, sound or not, graphics etc. found in the present website as well as their compilation are the exclusive property of Parfums GODET, which does not grant any license or any other right than that of consulting the website.

The reproduction or use of all or part of these elements is only authorised for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Neither all or part of the Site, nor its content, nor the trademarks may be used, reproduced, duplicated, copied, sold, resold, made accessible, modified or exploited in any other way, in whole or in part, for any purpose whatsoever. Any other use constitutes an infringement.

 

Article 15: Applicable law – Dispute

The present General Conditions of Sale and the contractual relations between Parfums GODET and the Client are governed by French law.

In the event of a dispute between Parfums GODET and the Client, an amicable settlement will be sought by the Parties, prior to any referral to a court.

Any dispute arising from the application or interpretation of the General Sales Conditions will, in the absence of an amicable agreement as stated above, fall under the jurisdiction of the Court of Appeal of Paris.

Any Order placed by a Customer implies an explicit and irrevocable waiver by the Customer of any action of any nature whatsoever which does not fall under the exclusive jurisdiction of French law.

Natural ingredients at the heart of our craftsmanship

Centifolia Rose

Born in the 17th century in mysterious conditions, the Centifolia Rose became the symbol and signature of Grasse for its noble fragrance with touches of honey. At sunrise in May, on the day the Rose blooms, it is picked. This is when the scents it contains are at their peak.

The flowers are mixed with a solvent, to become a mixture of juice, waxes and pigments, which is then turned into a fluid substance by the effect of an alcohol. Once the solution is filtrated and cooled and the alcohol has completely evaporated, the absolute is created. 1 kg of absolute requires about 300,000 flowers.

Jasmine Grandiflorum

Originally from northern India, the rare Jasmine Grandiflorum benefits from the unique geographical conditions of the city of Grasse, located between sea and mountains. These traditional flowers, with a sweet and fruity scent, and hints of delicacy, are picked at dawn, before the first sunrays.

As these flowers are extremely fragile, the most efficient technique that exists, is extraction through volatile solvents. The molecules of the Jasmin flower are extracted by a solvent: hexane . Hexane is then separated and discarded during decantation, concentration and successive filtrations. 1 kg of absolute requires between 600 and 700 kg of flowers.

Tuberose from Grasse

Tuberose is known for its sulphurous characteristics, associated with the power of its scents. Its bulbs planted in spring, bud into flowers at the end of summer to release its scent, which alternates between vegetal and heady, and creamy and sun-drenched.

To capture its soul, la Maison Godet uses the ancestral method of cold “enfleurage”, which consists of placing the freshly picked flowers in wooden frames soaked in fat. These are then renewed daily for 3 months. The absolute is extracted after filtration of the solid matter in alcohol.

Bergamot from Calabria

Being a cross between bitter orange and lemon trees, the bergamot is part of of the Mediterranean olfactory field. Its tangy pulp and reassuringly strong zest, produced by constant heat, make it a sure bet for fresh fragrances.

Essential in the Godet signature, this fruit is produced respecting the organic ways in its historic stronghold of Calabria. Thus it is free of pesticides, insecticides and chemical fertilizers. Its bark is used to produce the essential oil, which has had a Controlled Label of Origin (in French: AOC –  Appellation d’Origine Protégée) since 2001.

Violet Victoria

This type of violet is cultivated in Tourrettes-sur-Loup, in the hinterland of Nice. While the petals are used in confectionery, Violet leaves are used in perfumery. They are particularly adored by perfumers due to their green intense colouring, and sparkling, gourmand scented touch.

Tanneron's Mimosa

In France, the Tanneron massif remains unequalled/unchallenged in its impressive concentration of mimosa. It is here that these fluffy yellow balls, leaves and stems are picked in the middle of winter. Used and known for their powdery and deep scent, they are most recognizable, and thus selected, during their triumphant flowering, making the other flowers colourless.

The best olfactory extraction of the mimosa and its pollen is guaranteed through distillation. It is a mixture of water vapour with the plant, loaded with odorous molecules. Once cooled at low pressure this mixture will show an aqueous phase and the essential oil, which will eventually be collected.

Sacred Oud Wood

The “Bois d’Oud” is deeply rooted in spirituality: Buddhists burn it to help to meditate and are guided by the fluffiness that it symbolizes. Taken from Aquilaria-type trees, it must secrete a special resin that defends against fungi in order for its organic and oriental scents to come to life.
