Article 1: Definitions

Parfums GODET: refers to the company Parfums GODET, a Simplified Joint Stock Company (S.A.S.) with a share capital of €20,000, VAT number: FR 09 828 078 329, registered with the Antibes Trade and Companies Register, with its registered office located at 98, rue Grande, 06570 Saint-Paul de Vence, France.
Site: refers to the online sales website of Parfums GODET: www.parfumsgodet.com, where Products are presented and sold to the Customer. Product(s): refers to perfumery products, cosmetics, and accessories marketed by Parfums GODET and offered for sale on the Site. Customer: refers to the individual web user, acting as a non-professional consumer, who browses and/or places an Order on the Site for one or more Product(s) at retail for personal use. Party(ies): refers alternatively or collectively to Parfums GODET and/or the Customer.
Order: refers to the sales contract concluded between Parfums GODET and the Customer. General Terms and Conditions of Sale: refers to these terms and conditions for the sale of Products on the Site.

 

Article 2: Object

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Parfums GODET offers its Products for sale on its Site to Customers, as well as the rights and obligations of the Parties arising from the online sale of these Products.

The Customer acknowledges having read and expressly accepted the General Terms and Conditions of Sale in force on the day of the Order, prior to placing the Order on the Site. This acceptance is in no way conditional upon a handwritten signature by the Customer. These terms are available on the Site and can also be sent upon request via email or post. The Customer may save or print these terms provided they are not modified.

Parfums GODET reserves the right to update these terms at any time. In the event of a modification, the version in force at the date of the Order shall apply. These terms apply to all online sales on the Site to the exclusion of any other document, including terms applicable to in-store sales or other distribution channels. The resale or distribution of Parfums GODET Products purchased on the Site is strictly prohibited.

 

Article 3: Products

Parfums GODET offers for sale, within the limits of available stock, only those Products appearing on the Site on the day of consultation by the Customer. Parfums GODET reserves the right to withdraw Products from online sale at any time without prior notice. Product offers are limited to Orders placed for delivery to: Mainland France (including Corsica), Monaco, Andorra, Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, United Kingdom, Italy, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Ireland, Denmark, Portugal, Finland, Bulgaria, Romania, Turkey, and Switzerland. Parfums GODET endeavors to meet the requirements of Article L 111-1 of the French Consumer Code. The Customer can review the essential characteristics of the Product(s) before ordering. However, photographs illustrating the Products are for indicative purposes only and do not enter the contractual field. Purchase offers, including promotional offers, are valid as long as they are announced on the Site. Any promotional offer not originating from the Site cannot be validly asserted against Parfums GODET.

 

Article 4: Prices

The applicable rate is that indicated on the Site. Prices are expressed in Euros and include all taxes (TTC), including the VAT applicable in France on the day of the Order. For countries outside the European Community, sales will be made excluding tax (HT). Prices do not include shipping costs, which will be billed extra and indicated before the Customer registers the Order. Parfums GODET reserves the right to modify its prices at any time; Products are billed based on the rate in effect at the time of Order registration.

 

Article 5: Orders

Products ordered are for the Customer’s personal use, with no direct connection to their professional activity. To purchase Products, the Customer must log in with their email and password or create an account by providing their title, surname, first name, address, email, and password. Validation of any Order implies unreserved acceptance of these Terms. The Order is only definitively validated after the Customer has chosen the delivery and payment methods and clicked “Order.” Before clicking, the Customer can check the Order details, total price, and modify or cancel it. Order validation serves as an agreement between the Parties. Payment validation and the confirmation email from Parfums GODET constitute proof of acceptance and final validation. Data recorded by Parfums GODET and the payment provider constitute proof of the nature, content, and date of the Order. Once validated, the Order cannot be cancelled or modified, subject to Article 10. Payment is triggered upon validation. In case of unavailability after the Order, the Customer will be informed via email. The Order will be cancelled, the payment refunded, and Parfums GODET will notify the Customer when the product is back in stock. Parfums GODET is not liable for stock shortages. Parfums GODET reserves the right to cancel any Order from a Customer with a prior dispute or for any legitimate reason, such as unusual order quantities for a final consumer. Orders for delivery outside France may involve different processing times, especially for VAT-exempt deliveries.

 

Article 6: Payment

All Orders are payable in Euros.

• Bank Card: Payment is made exclusively via Visa or Mastercard through the secure Paybox system connected to Crédit Mutuel. All information is encrypted and transmitted directly to Paybox. Transactions are secured via SSL encryption.
• PayPal: Holders of a PayPal account can pay online by entering their email and password. Financial information is never shared with Parfums GODET.
• Card Payment via PayPal: The Customer provides the card number, expiry date, and CVX code. By checking “Remember,” the Customer agrees to save card details for future purchases.

The total amount will be debited on the day of the Order. Parfums GODET reserves the right to suspend any Order or delivery in case of payment refusal or non-payment of a previous Order. In accordance with the “Informatique et Libertés” law of January 6, 1978, the Customer has the right to access, rectify, and oppose their personal data.

 

Article 7: Delivery

Products will be delivered to the address indicated during the Order process. The delivery period begins upon sending the confirmation email. In accordance with current law, Parfums GODET commits to fulfilling the Order within a maximum of thirty days, subject to availability and full payment. If delivery fails after this period, the Customer may cancel the Order and receive a refund.

 

Article 8: Collection Period at Pickup Points

In the case of delivery to a pickup point (Point Relais), the Customer must collect the package within the timeframe set by the carrier. If this period is exceeded, resulting in the return of the package, all additional costs (re-shipping, storage, or processing) will be fully charged to the Customer.

 

Article 9: Returns for Customers Outside the European Union

For Customers residing outside the EU, all return costs, customs duties, import/export taxes, and other additional fees related to a return are the sole responsibility of the Customer, except in cases of a proven error by Parfums GODET (non-compliant product, reference error, or defective item).

No refund of costs incurred will be made for returns based on a change of mind or customer error.

 

Article 10: Refund in Case of Error or Defective Product

If a delivered product is defective or non-compliant with the order, we will cover all return costs and provide a full refund for the product.

The Customer must notify Customer Service upon receipt, providing evidence (photos, order reference, etc.).

 

Article 11: Retention of Title

Products remain the property of Parfums GODET until full payment. No dispute regarding the delivery itself is possible if the package appears as “delivered” in the carrier’s system or by the signature on the delivery slip.

 

Article 12: Receipt of Order – Complaints

Upon receipt, the Customer must check the packaging and Products. In case of damage or partial loss, reserves must be noted on the delivery receipt and communicated to Parfums GODET via email, post, or phone.

Article 13: Right of Withdrawal

In accordance with Article L. 121-20 of the French Consumer Code, the Customer has fourteen (14) clear days from delivery to exercise their right of withdrawal. The Customer then has fourteen days to return the unopened products in their original packaging at their own expense.

Important: We accept returns under the right of withdrawal (14-day limit) only in the form of an exchange or credit note. No cash refunds will be issued for withdrawals.

 

Article 14: Legal Warranty

The Customer benefits from the legal warranty of conformity and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Parfums GODET will either exchange the product for one of equivalent quality/price or refund the Customer within 15 days of receipt of the returned item.

 

Article 15: Liability

Parfums GODET is bound by an obligation of means. The Customer is responsible for judging the suitability of the products for their needs. Parfums GODET is not liable for non-compliant use. As delivery is handled by third parties, Parfums GODET declines responsibility for delivery delays, loss of products, or strikes by postal services. The Customer assumes risk upon taking possession of the products. Parfums GODET does not guarantee that the Site will be available without interruption or error.

 

Article 16: Force majeure

Parfums GODET shall not be liable for total or partial non-performance of its obligations if caused by a force majeure event. Such events suspend or extinguish obligations without compensation to the Customer.

 

Article 17: Intellectual Property

The Site and all elements (brands, designs, photos, texts, logos, etc.) are the exclusive property of Parfums GODET. No license or right other than consulting the Site is granted.

Reproduction or use is authorized for personal and private information purposes only. Any other use constitutes infringement.

 

Article 18: Applicable Law – Disputes

These Terms and the contractual relationship are governed by French Law. In case of a dispute, an amicable solution will be sought before any legal action. Any dispute failing an amicable settlement shall fall under the jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal. Placing an Order implies an explicit and irrevocable waiver by the Customer of any action not falling under the exclusive jurisdiction of French law.
